Description
A LENGTHY JOHN MARSHALL LEGAL DOCUMENT, SIGNED BY HIM TEN TIMES JOHN MARSHALL (1755-183). Marshall was the fourth Chief Justice, serving for thirty-five years. He oversaw landmark decisions such as Marbury v. Madison, McCulloch v. Maryland, Gibbons v. Ogden and the Dartmouth College case. ADS. 2pg. 8” x 13 ¼”. June 18, 1816. No place [Virginia]. A lengthy autograph document signed “John Marshall” nine times in the text and “J Marshall” once at the end while he was Chief Justice. He penned: “This indenture made this eighteenth day of June in the year one thousand eight hundred and sixteen between Walter L. Fontaine of the county of Buckingham of the one part and John Marshall of the city of Richmond of the other part witnesseth that the said Walter L. Fontaine for and in consideration of the sum of four thousand two hundred and fifteen dollars to him the said Walter L. Fontaine in hand paid by him the said John Marshall at and before the sealing and delivery of these present he the said Walter L. Fontaine Hath granted bargained and sold and doth by these present grant bargain and sold to the said John Marshall one certain tract of land lying on Randolph’s neck in the county of Buckingham containing by estimation four hundred and twenty one and one half acres being the same land which is conveyed to the said Walter L. Fontaine by John Marshall and Mary Willis his wife by deed bearing even date with these presents and executed before the execution of this indenture To have and to hold the said tract of land to him the said John Marshall his heirs and assigned for ever but on this condition, that whereas the said Walter L. Fontaine stands justly indebted to the said John Marshall in the sum of four thousand two hundred and fifteen dollars payable one third on the first day of March in the year one thousand eight hundred and seventeen, one third on the first day of March one thousand eight hundred and eighteen, and the remaining third on the first day of March in the year one thousand eight hundred and nineteen, now if the said Walter L. Fontaine shall will & truly pay to the said John Marshall the said sums of money as they shall respectively become due then this indenture and the estate hereby granted bargained and sold shall ceased determine and be utterly void. And the said Walter L. Fontaine for himself his heirs exers & admins doth covenant and agree to and with the said John Marshall that he the said Walter L. Fontaine shall and will well and truly pay to the said John Marshall the said several sums of money herein before specified as the same shall become due and payable. In Witness whereof the said Walter L. Fontaine hath hereunto set his hand and affix his seal the say and year first above written…Mr. Fontaine is at liberty to pay the sum due in four installments instead of three he paying interest on so much as remains due on each installment estimating them as in this deed. J Marshall”. It is signed at the conclusion “W L Fontaine” and four other witnesses. At the bottom of the second page is the schedule of payments, covering 1817 to 1821, that is also in Marshall’s handwriting. The document is in very good to fine condition. There is light age toning and folds, some uneven margins and light chipping, and a slight stain, consisting of dots, on the first page but away from the text.
